Terms of Service

1. Acceptance of Terms

By accessing or using EcoBuild Pro (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, do not use the Platform.

2. Description of Service

EcoBuild Pro is a construction management platform that provides AI-powered estimating, blueprint takeoff, proposal generation, project management, CRM, and related tools for construction professionals and organizations.

3. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.
• One person or organization may not maintain more than one free-tier account.

4. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
• Interfere with or disrupt the Platform or servers connected to it.
• Upload malicious code, viruses, or harmful content.
• Scrape, crawl, or use automated means to access the Platform without our written consent.
• Resell, sublicense, or redistribute the Platform without authorization.
• Use AI-generated outputs to misrepresent professional credentials or certifications.

5. Your Data

You retain ownership of all data you upload or create on the Platform (“Your Data”). By using the Platform, you grant us a limited license to process Your Data solely to provide and improve our services. We will not use Your Data for purposes unrelated to the Platform without your consent.

You are responsible for ensuring you have the right to upload and use all content you submit, including blueprints, photos, and client information.

6. AI-Generated Content

The Platform uses artificial intelligence to generate estimates, proposals, takeoff measurements, content, and other outputs. You acknowledge that:

• AI outputs are provided as suggestions and should be reviewed by qualified professionals before use.
• EcoBuild Pro does not guarantee the accuracy, completeness, or suitability of AI-generated outputs.
• You are solely responsible for verifying and approving all AI-generated estimates, proposals, and measurements before presenting them to clients or using them in business decisions.
• AI-generated content does not constitute professional engineering, architectural, or legal advice.

7. Billing and Payments

• Paid plans are billed on a recurring basis (monthly or annually) as selected at signup.
• All fees are non-refundable except as required by law or as stated in our refund policy.
• We reserve the right to change pricing with 30 days' notice. Existing subscriptions will honor their current billing cycle.
• AI credits are consumed based on usage. Unused credits do not roll over between billing periods unless specified by your plan.
• Failed payments may result in suspension of service after a 7-day grace period.

8. Intellectual Property

The Platform, its design, code, features, documentation, and branding are owned by EcoBuild Pro and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

9. Limitation of Liability

To the maximum extent permitted by law, EcoBuild Pro and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any reason with reasonable notice. You may cancel your account at any time through your account settings. Upon termination, your right to use the Platform ceases immediately. We will make your data available for export for 30 days following termination.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Travis County, Texas.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Platform at least 30 days before the changes take effect. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.
